In this brief paper, offered as a policy viewpoint, I introduce what I believe to be a novel concept for supporting individual citizen interaction with the U.S. Federal government, termed the individual social account. I explore whether and how the concept might be implemented so as to strengthen the U.S. social safety net and further citizen trust and responsibility in e-government interactions. I illustrate and develop the concept as a platform for reform and suggest and discuss design criteria, surfacing various (...) issues. I conclude with additional thoughts with which to stimulate further research and discussion of the concept and its practicalities. (shrink)

Increasing genetic knowledge over the last decade has enabled hundreds of genetic variants associated with inherited cardiac conditions to be identified, many of which cause increased risk of sudden cardiac death. While individually these conditions are rare, taken together they impose a significant burden. The severity of these conditions—the possibility that they might cause sudden unheralded death of a teenager or young adult—juxtaposed with uncertainty about the pathology linked with many of the genetic variants is significant in terms of professional (...) practice because, increasingly, clinicians have been encouraged to cascade out genetic testing from the proband or consultand to other family members who may be at risk of developing the same condition. This process often involves sharing human tissue samples, DNA or personal information. This paper reviews the legal and regulatory frameworks which may apply when tissue and DNA samples are collected, used and retained, both for the purpose of diagnosis and for benefiting other family members, when a suspected or definitive diagnosis of an inherited cardiovascular condition is made. Sometimes the interests of family members may conflict, and it may be difficult for practitioners to reconcile the interests of one family member with another, particularly if the balance of benefits and harms from testing is unclear. The paper then examines some of the ethical tensions which may arise in practice and concludes that all involved should be conversant with the legal and ethical frameworks that apply. (shrink)

To consciously bolster behaviour that is disapproved by others (i.e., stigmatised behaviour) people may hold and report a favourable attitude toward the behaviour. However, achieving such bolstering outside awareness may be more difficult. Explicit attitudes were measured with self-report measures, and the Implicit Association Test was used to assess implicit attitudes toward behaviour held by stigmatised actors (smokers) and nonstigmatised actors (vegetarians and omnivores). Smokers' showed greater attitude-behaviour consistency in their explicit attitudes toward smoking that in their implicit attitudes. By (...) contrast, vegetarians and omnivores showed attitude-behaviour-consistency at both implicit and explicit levels. Smokers' implicit negative attitudes toward smoking may reflect its status as a stigmatised behaviour, or its addictive nature. (shrink)

Over the past 40 years, scholars and practitioners of public relations have often cast public relations workers in the role of the public relations-person-as-corporate-conscience. This work, however, maintains that this construct is so problematic that invoking it is of negligible use in addressing ethical issues that emerge during a crisis. In fact, a complex crisis, such as the Jahi McMath “brain death” case at Children’s Hospital Oakland, demonstrates the need to abandon the PRPaCC construct to better engage affected stakeholders, including (...) “outsiders” to the organization, who often determine whether an organization is facing a crisis. Through an examination of both the concept of the PRPaCC and the McMath crisis, this work makes the case for moving beyond the PRPaCC construct in favor of a more modest role for the public relations person: facilitating widespread ethical deliberation and discussion throughout an organization, potentially helping the organization alleviate concerns that contribute to crises. An investigation is presented in which a computer simulation model (DIAGNOSER) is used to develop and test predictions for behavior of subjects in a task of medical diagnosis. The first experiment employed a process‐tracing methodology in order to compare hypothesis generation and evaluation behavior of DIAGNOSER with individuals at different levels of expertise (students, trainees, experts). A second experiment performed with only DIAGNOSER identified conditions under which errors in reasoning in the first experiment could be related to interpretation of specific (...) data items. Predictions derived from DIAGNOSER's performance were tested in a third experiment with a new sample of subjects. Data from the three experiments indicated that (1) form of diagnostic reasoning was similar for all subjects trained in medicine and for the simulation model, (2) substance of diagnostic reasoning employed by the simulation model was parable with that of the more expert subjects, and (3) errors in subjects' reasoning were attributable to deficiencies in disease knowledge and the interpretation of specific patient data cues predicted by the simulation model. Conventional wisdom has it that many intriguing features of indicative conditionals aren’t shared by subjunctive conditionals. Subjunctive morphology is common in discussions of wishes and wants, however, and conditionals are commonly used in such discussions as well. As a result such discussions are a good place to look for subjunctive conditionals that exhibit features usually associated with indicatives alone. Here I offer subjunctive versions of J. L. Austin’s ‘biscuit’ conditionals—e.g., “There are biscuits on the sideboard if you want them”—and subjunctive (...) versions of Allan Gibbard’s ‘stand-off’ or ‘Sly Pete’ conditionals, in which speakers with no relevant false beliefs can in the same context felicitously assert conditionals with the same antecedents and contradictory consequents. My cases undercut views according to which the indicative/subjunctive divide marks a great difference in the meaning of conditionals. They also make trouble for treatments of indicative conditionals that cannot readily be generalized to subjunctives. (shrink)

Coastal ecosystems are increasingly dominated by humans. Consequently, the human dimensions of sustainability science have become an integral part of emerging coastal governance and management practices. But if we are to avoid the harsh lessons of land management, coastal decision makers must recognize that humans are one of the more coastally dependent species in the biosphere. Management responses must therefore confront both the temporal urgency and the very real compromises and sacrifices that will be necessary to achieve a sustainable coastal (...) ecosystem, one that is economically feasible, socially just, and ecologically sound. Motivated by analogous applications to sonoluminescence, neutron stars mergers are examined in the context of Schwinger's dynamical Casimir effect. When the dielectric properties of the QED vacuum are altered through the introduction of dense matter, energy shifts in the zero-point fluctuations can appear as photon bursts at gamma-ray frequencies. The amount of radiation depends upon the properties and amount of matter in motion and the suddenness of the transition. It is shown that the dynamical Casimir effect can convert sufficient energy (...) of neutron star mergers into gamma rays. Using information extracted from simulations of matter flow in neutron star mergers by Ruffert and Janka, we estimate that the total Casimir energy released can exceed 10 53 ergs in gamma-ray frequencies. The Casimir energy approach is capable of explaining the most energetic gamma-ray bursts. (shrink)

One of the most popular Asian classics for roughly two thousand years, the Vimalakirti Sutra stands out among the sacred texts of Mahayana Buddhism for its conciseness, its vivid and humorous episodes, its dramatic narratives, and its eloquent exposition of the key doctrine of emptiness or nondualism. Unlike most sutras, its central figure is not a Buddha but a wealthy townsman, who, in his mastery of doctrine and religious practice, epitomizes the ideal lay believer. For this reason, the sutra has (...) held particular significance for men and women of the laity in Buddhist countries of Asia, assuring them that they can reach levels of spiritual attainment fully comparable to those accessible to monks and nuns of the monastic order. Esteemed translator Burton Watson has rendered a beautiful English translation from the popular Chinese version produced in 406 C.E. by the Central Asian scholar-monk Kumarajiva, which is widely acknowledged to be the most felicitous of the various Chinese translations of the sutra and is the form in which it has had the greatest influence in China, Japan, and other countries of East Asia. Watson's illuminating introduction discusses the background of the sutra, its place in the development of Buddhist thought, and the profundities of its principal doctrine: emptiness. (shrink)

We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. There is much to admire in John Pittard’s recent book on the epistemology of disagreement. But here we develop one concern about the role that rational insight plays in his project. Pittard develops and defends a view on which a party to peer disagreement can show substantial partiality to his own view, so long as he enjoys even moderate rational insight into the truth of his view or the cogency of his reasoning for his view. Pittard argues that this may (...) happen in ordinary cases of religious disagreement—cases in which it’s a live skeptical possibility that one is misdescribing his insight, or not having insight at all—and therefore one need not be strongly conciliatory even in the face of peer disagreement. Yet Pittard agrees that one should be strongly conciliatory in cases of disagreement involving, e.g., visual perception and dim rational insight, since the sort of fallible, corrigible evidence involved in such cases may be counterbalanced by symmetrical evidence on the part of one’s disagreeing peer. We worry that there’s an inconsistency here. If it’s unreasonable to show partiality to one’s visual experience (or dim rational insight) in cases like “Horse Race” and “Restaurant Check,” it’s likewise unreasonable to show partiality in religious disagreements to one’s moderate rational insight, fallible and corrigible as it is. Increased knowledge of the gene–disease associations contributing to common cancer development raises the prospect of population stratification by genotype and other risk factors. Individual risk assessments could be used to target interventions such as screening, treatment and health education. Genotyping neonates, infants or young children as part of a systematic programme would improve coverage and uptake, and facilitate a screening package that maximises potential benefits and minimises harms including overdiagnosis. This paper explores the potential justifications and risks of genotyping children (...) for genetic variants associated with common cancer development within a personalised screening programme. It identifies the ethical and legal principles that might guide population genotyping where the predictive value of the testing is modest and associated risks might arise in the future, and considers the standards required by population screening programme validity measures . These are distinguished from the normative principles underpinning predictive genetic testing of children for adult-onset diseases—namely, to make best-interests judgements and to preserve autonomy. While the case for population-based genotyping of neonates or young children has not yet been made, the justifications for this approach are likely to become increasingly compelling. A modified evaluative and normative framework should be developed, capturing elements from individualistic and population-based approaches. This should emphasise proper communication and genuine parental consent or informed choice, while recognising the challenges associated with making unsolicited approaches to an asymptomatic group. Such a framework would be strengthened by complementary empirical research. (shrink)

Grelling's Paradox is the paradox which results from considering whether heterologicality, the word-property which a designator has when and only when the designator does not bear the word-property it designates, is had by 'heterologicality'. Although there has been some philosophical debate over its solution, Grelling's Paradox is nearly uniformly treated as a variant of either the Liar Paradox or Russell's Paradox, a paradox which does not present any philosophical challenges not already presented by the two better known paradoxes. The aims (...) of this paper are, first, to offer a precise formulation of Grelling's Paradox which is clearly distinguished from both the Liar Paradox and Russell's Paradox; second, to offer a solution to Grelling's Paradox which both resolves the paradoxical reasoning and accounts for unproblematic predications of heterologicality; and, third, to argue that there are two lessons to be drawn from Grelling's Paradox which have not yet been drawn from the Liar or Russell's Paradox. The first lesson is that it is possible for the semantic content of a predicate to be sensitive to the semantic context; i.e., it is possible for a predicate to be an indexical expression. The second lesson is that the semantic content of an indexical predicate, though unproblematic for many cases, can nevertheless be problematic in some cases. In Section 1, Grelling's Paradox is presented informally. After making some refinements, Grelling's Paradox is then presented formally. In Section 2, the formal version of Grelling's Paradox is evaluated, and several previously proposed solutions are discussed and argued to be inadequate. In Section 3, it is argued that the heterologicality predicate is an indexical expression. A semantics for the heterologicality predicate is given, and it is shown how this semantics accounts for the unproblematic predications of heterologicality, as well as the problematic cases, and therefore constitutes a satisfactory and complete solution to Grelling's Paradox. Objections to this solution are addressed in Section 4. The conclusions of this paper are summarized in Section 5. (shrink)

Few studies have examined the influence of the food environment on obesity rates among very young, low-income consumers. This research contributes to this growing literature by examining the relationship between modifications to the retail environment and obesity rates for low-income, preschool-aged children. Based on data combined from various secondary sources, this study finds that changes in the retail environment are significantly related to obesity rates. More specifically, the authors find a positive relationship between the number of convenience stores in the (...) retail environment and obesity rates among low-income, preschool-aged children. Results also show that the percent change in grocery stores and supercenters and club stores in the retail environment is negatively related to the obesity rates of low-income, preschool-aged children [i.e., as grocery stores and supercenters/club stores increase, obesity decreases ].Further, the percent change in supercenters and club stores mediates the positive relationship between participation in the Supplemental Nutrition Assistance Program and obesity rates. This article seeks to explain the variable implementation of gender mainstreaming as a `policy frame' over time and across various international organisations (I.O.s). In the years since the U.N. Fourth World Women's Conference in Beijing (1995),mainstreaming has been endorsed and adopted by a wide range of international organisations, and we compare the adoption and implementation of mainstreaming in four specific I.O.s: the World Bank, the United Nations Development Programme, the Organisation for Security and Cooperation in Europe, and the European Union. The rhetorical acceptance of mainstreaming by various international organisations, however, obscures considerable variation in both the timing and the nature of the mainstreaming process within and among organisations. This variation, in turn, can be explained in terms of the categories of political opportunity, mobilising structures and strategic framing, which have been put forward by social movement theorists. Sentencing practices in cases of domestic homicide have been the object of critical scrutiny on previous occasions across a number of jurisdictions. It has been suggested by some that these practices reveal judges to be taking a more lenient approach to women who kill their violent male partners than to men who kill allegedly unfaithful female partners. This note evaluates claims of gender bias in sentencing practices in UK cases of domestic homicide following the Court of Appeal sentencing decision in (...) R. v. Suratan, R. v.Humes and R.v. Wilkinson [2002]E.W.C.A. 2982 concerning three men who killed their female partners. It will argue that in the wake of this decision current proposals to review both the substantive law of provocation and sentencing practices are to be welcomed. (shrink)

This paper opens with first‐hand accounts of critical care medical interventions in which detainees, in the custody of U.S. Immigration and Customs Enforcement (ICE), are brought to the emergency department for treatment. This case dramatizes the extent to which the provision of ethical and acceptable nursing care is jeopardized by federal law enforcement paradigms. Drawing on the scholarship of Michel Foucault and Giorgio Agamben, this paper offers a theoretical account of the power dynamics that inform the health care of patients (...) who find themselves caught in the custodial scaffolding of a vast immigration and detention apparatus. It offers an analysis of the display of sovereign and biopolitical power over the lives (and deaths) of detainees (Foucault), as well as the ways these individuals are reduced to “bare life” under the political pretext of an emergency or “state of exception” (Agamben). Our purpose here is both theoretical and practical: to better understand the often hidden agency or impersonal “will” exercised by the immigrant detention system, but also to equip clinicians in these and cognate facilities (e.g., prisons) with the critical tools by which they might better navigate incommensurable paradigms (i.e., care vs. custody) in order to deliver the best care while upholding their ethical duties as a care provider. This is all the more pressing because hospitals are not sanctuaries and given the incursion of federal law enforcement agents, nurses may find themselves conscripted as de facto agents of the state.
